Hotel Registers Act, No. 1 of 1909

An Act to provide for the keeping of books in hotels and other places in which visitors shall be required to enter their names and other particulars.

1. Short title

This Act may be cited as the Hotel Registers Act, No. 1 of 1909.

2. Duty to keep book

(1)Every keeper or person having the management of a place used as an hotel, boardinghouse, lodging-house or other place wherein persons receive sleeping accommodation for money or valuable consideration shall keep a book in which every person immediately he first receives such accommodation shall enter his name and the place from which he last came.
(2)The Minister for Tourism, Environment and Communication may, by notice in the Gazette prescribe the form of the book to be kept under this section.

3. Inspection

Every such book shall be open at all reasonable times to the inspection of any police officer.

4. Offences and penalties

Any person who fails to comply with the requirements of this Act or who obstructs or prevents any police officer in carrying out his powers or making any false entry in any such book shall be guilty of an offence and liable on conviction to a fine not exceeding fifty emalengeni or in default of payment thereof, to imprisonment for a period not exceeding one month or to both such fine and imprisonment.
