Nursing Sisters (Retiring Allowances) Act, 1944

An Act to make provision for the payment of retiring allowances to nursing sisters appointed through the Overseas Nursing Association.

1. Short title

(1)This Act maybe cited as the Nursing Sisters (Retiring Allowances) Act, 1944.
(2)In this Act—“Minister” means the Minister for Health;“nursing sister” means a nurse, nursing sister, health visitor, or matron, who has received an appointment in the public service or in a public hospital through the Overseas Nursing Association;“public hospital” includes any hospital controlled by a regularly constituted governing body and not conducted for private profit;“public service” and “other public service” shall have the meanings ascribed to them in subsection (1) of section 2 of the Pensions Act, No. 3 of 1968.

2. Grant of retiring allowances

(1)Subject to the provisions of this Act the Minister may grant a nursing sister who has served for not less than three years in the Government, on her retirement from the public service or from service in a public hospital, a retiring allowance calculated at the rate of two emalangeni per annum for each completed month of her service in the Government.
(2)No such retiring allowance shall be granted unless the nursing sister shall have completed not less than fifteen years’ service in the public service or in public hospitals, and no such retiring allowance shall become payable until the nursing sister shall have attained the age of fifty years:Provided that if the Minister is satisfied that the nursing sister’s retirement is due to infirmity of mind or body, and her aggregate service in the public service or in public hospitals amounts to not less than ten years, he may direct that a retiring allowance shall be paid to her with effect from the date of her retirement.
(3)Service qualifying for the grant of a retiring allowance need not be continuous.

3. Conditions of grant of allowances

No retiring allowance shall be granted under this Act without a certificate from the Director of Medical Services that the applicant has discharged her duties with diligence and fidelity to his satisfaction.

4. Allowance to be charged on revenue of Swaziland

Any retiring allowance payable under this Act shall be charged on and paid out of the Consolidated Fund.

5. Application of Act

(1)This Act shall apply in the case of any nursing sister appointed to the service of the Government on or after the first day of June, 1943, or who, having been in the service of the Government before that date, was on that date in the service of the Government or in other public service or in the service of a public hospital.
(2)This Act shall not apply to any nursing sister who has been or may hereafter be admitted to the pensionable establishment unless she shall elect at the time of her retirement to receive a retiring allowance in accordance with the provisions of this Act in lieu of the pension or gratuity for which she may be eligible in accordance with the Pensions Act, No. 3 of 1968.
