Identity and Travel Documents Act, 1959

An Act to make provision for the identification of residents of Swaziland travelling beyond Swaziland.

1. Short title

This Act may be cited as the Identity and Travel Documents Act, 1959.

2. Interpretation

In this Act unless the context otherwise requires—"Minister" means the Minister for Home Affairs.

3. Documents of identity

(1)The Minister may in his discretion issue a document of identity to any resident in Swaziland who desires to travel outside Swaziland.
(2)A document of identity shall be in such form and issued subject to such conditions as the Minister may from time to time prescribe.

4. Documents of travel

(1)The Minister may in his discretion issue a travel document to any resident in Swaziland who desires to travel outside Swaziland.
(2)A travel document shall be in such form and issued subject to such conditions as the Minister may prescribe.

5. Offences and penalty

Any person who—
(a)fabricates or falsifies any document of identity or travel document issued under this Act; or
(b)with intent to deceive, utters or attempts to use any document or identity or travel document which has not been issued under this Act or any other law; or
(c)utters, uses or attempts to use any fabricated or falsified identity or travel document knowing it to have been so fabricated or falsified; or
(d)knowingly gives any false information in respect of any particulars required in connection with the issue under this Act of a document of identity or a travel document,
shall be guilty of an offence and shall be liable upon conviction to a fine not exceeding two hundred emalangeni or in default of payment thereof to imprisonment with or without hard labour for a period not exceeding twelve months.
