A King’s Order-in-Council to recognise the establishment of a separate Swaziland Diocese of the Anglican Church and to provide for incidental and connected matters.

1. Short title

This King’s Order-in-Council may be cited as The Diocese of Swaziland Order, 1977.

2. Interpretation

In this Order unless the context otherwise requires—Church” means the Church of the Province of South Africa.

3. Incorporation of Diocese

(1)There is hereby established and constituted a diocese of the Church to be known as The Diocese of Swaziland which shall be a body corporate, having perpetual succession, capable of suing and being sued under that name and having the power through its Trusts’ Board mentioned in subsection (2) to acquire, hold and dispose of movable and immovable property, and to perform such other acts as a body corporate may lawfully perform.
(2)The affairs of the Diocese of Swaziland shall be governed by a Synod to be known as The Swaziland Diocesan Synod, in accordance with canons approved by that Synod, which shall determine the first and subsequent members of the Swaziland Diocesan Standing Committee and Swaziland Diocesan Trusts’ Board in accordance with the said canons.

4. Vesting of property

On the commencement of this Order—
(a)all the assets within Swaziland and liabilities enforceable within Swaziland of the Zululand Diocesan Trusts’ Board are hereby vested in and imposed upon the Swaziland Diocesan Trusts’ Board and such Trusts’ Board shall be entitled to deal therewith as fully and effectually as the Zululand Diocesan Trusts’ Board might or could had this Order not been passed;
(b)all deeds, bonds, instruments and contracts relating to such assets or liabilities subsisting immediately before such commencement to which the Zululand Diocesan Trusts’ Board is a party shall be of as full force and effect against or in favour of the Swaziland Diocesan Trusts’ Board and enforceable as fully and effectually as if, instead of the Zululand Diocesan Trusts’ Board, the Swaziland Diocesan Trusts’ Board has been a party thereto;
(c)the Register of Deeds shall make any necessary endorsements or attestations to his records and documents relating to the assets referred to in this section as may be necessary to give effect to the provisions of this section.
