The accused Sphiwe Dlamini is charged in the Magistrate Court for the District of Hhohho held at Mbabane. The charge is one of theft arising out of the alleged misappropriation of 4 Government cheques to the value of E4,396.00. The presiding Magistrate was J.P. Anandale who has now left the country and there is no possibility of him being recalled to complete the case. In these circumstances I order that the proceedings be set aside and that they may be started afresh before another Magistrate of the appropriate rank.
