This is a similar matter to that in Civil Case No 2645/97. The facts are the same so is the cause of action. The only difference is that the defendant in the respective cases are two totally different companies. When the matter came for argument both counsel submitted that the arguments in Civil Case No 2645/97 also apply in the present case. That for purposes of convenience should be treated as one.
I thus state that my reasons and conclusions in Case No 2645/97 have equal force in the case in casu. For practical purposes this judgement (for lack of a better word) should go together with my main judgement in Civil Case No 2645/97.
