SENTENCE 6/11/06




[1] In passing sentence I have taken your personal circumstances into accour.L as presented by your attorney.


[2] I have also looked at the circumstance surrounding the commission of the crime. It is alcohol related. A knife was used. The medical report states that death was due to hemorrhage as a result of a penetrating injury to the left lung and aorta. That in my view is very serious.


[3] Society expects me to sentence you appropriately so that would be offenders are deterred from this random taking of lives. The friend that gave you the knife should also have been charged together with you. Our people continue to decimate one another without regard of the consequences nor for the deceased's family.


[4] I sentence you to 10 years imprisonment 2 years of which are suspended for 3 years on condition that you are not convicted of a crime in which assault is an element.


[5] The sentence is backdated to 23/9/05. You have a right of appeal against the sentence.
