[1] On the 6 July, 2009 I heard arguments of the parties regarding an application brought by the Appellants to be released on bail pending the hearing of their appeals on the merits. In arguments Counsel from both sides were of the view that if the court could be constituted to hear the
appeal on the merits there will be no need to address the issue of bail pending appeal. I indicated to both Counsels that I will try to secure another judge to sit with me on the appeal. I have secured to sit with my Brother Annandale J on a date to be agreed by the parties this month.
