Criminal procedure and evidence: The accused are charged with unlawful hunting or possession of royal game in contravention of provisions of the Game Act/1953, alternatively with theft of the royal game. They also face multiple charges for possession  and carrying  of 4 firearms  in contravention  of provisions  of the Arms and  Ammunition  Act/I 953 as amended.  The accused  were found guilty of possession of the royal game without a permit. Their conviction was based on common purpose arising on their participation and cooperation handling meat of killed kudu without a permit. However the crown case collapsed in respect of possession of arms and ammunition because of insufficient evidence to support common purpose
