Criminal Procedure - Both pleaded not guilty to murder but guilty to culpable homicide - 1s t Accused accordingly convicted and sentenced to eight (8) years imprisonment for culpable homicide - of which three (3) years are suspended conditionally, while 2nd Accused found not guilty of culpable homicide notwithstanding his plea of guilty because the evidence in the statement of agreed facts could not link him with commission of the offence
