Nabaala v Mbabane Hotels (Pty) Ltd and Others (342/23) [2024] SZIC 8 (26 January 2024)

The Applicant filed the present application seeking an order directing the first respondent to institute the disciplinary proceedings against him instead of the second respondent. The applicant also wants the court to stop the participation of the Human Resource Manager of tlte second respondent in its disciplinary hearing. Applicant also wants its suspension uplifted as the person wlto issued it allegedly did not have the requisite authority to suspend him being an employee of Bon Hotels, which is alleged to be a separate and distinct entity.
