Rex v Sikjondze [2004] SZHC 119 (26 July 2004)

THE HIGH COURT OF SWAZILAND

REX

Vs

ZAMILE SIKHONDZE

Criminal Case No. 88/2004

Coram S.B. MAPHALALA – J

For the Crown MR. FAKUDZE

For the Defence MR. B.J. SIMELANE

SENTENCE (26/07/2004)

I have listened to the submissions made by Mr. Simelane who is appearing on your behalf in mitigation of sentence. He has directed my attention to the report made by the psychiatrist at the Manzini National Psychiatrist Hospital. Secondly, that when you committed this offence you were sixteen (16) years old, and that you were arrested for this offence on the 4th August 2003, and that you left school at Standard V, I agree with Mr, Simelane that this action will haunt you for the rest of your life.

In the circumstances of this rather tragic case, I sentence you to six (6) years imprisonment, however the whole sentence will be suspended for a period of three

2

years on condition that you are not convicted of an offence in which violence is an element committed during the period of suspension.

S.B. MAPHALALA
